This Membership Agreement (“Agreement”) is concluded electronically between ARCONA TEKNOLOJİ A.Ş. (Haci Saki Mah. Kenarcik St. 7H, 38020 Kocasinan / Kayseri, Türkiye, Tel: +90 850 811 4020, Email: info@arconasarj.com) (“Arcona”) and the natural or legal person who joins the Arcona charging network (“Member”).
1. Subject
The Agreement governs charging at Arcona’s public and partnered sites, the mobile app, the web interface, start-by RFID / QR / screen, tariffs, campaigns and the membership account.
2. Forming membership
- Membership is created through the mobile app or other channels Arcona designates, with accurate and current information.
- The Member must be 18 or older, or transact through a legal representative.
- The Member is responsible for the security of the account, password and RFID card, and must report a lost card at once.
- Arcona may suspend or end membership in case of false information, misuse or a breach of law.
3. Scope of the service
- Arcona supplies charging for battery-electric and plug-in hybrid vehicles on AC and DC units that comply with EN 61851 and related standards.
- Charging may be started from the app, a QR code, an RFID card or the unit screen. AutoCharge may be available on some vehicles.
- Availability, power and connector type depend on the vehicle, occupancy and site conditions. Arcona does not guarantee a specific charge time or uninterrupted access.
- Map pins are for information; live status follows the app and conditions on site.
4. Tariffs, payment and idle fee
- The fee is energy drawn (kWh) times the socket tariff. Published prices include VAT. Member discounts follow the campaign calendar.
- Illustrative tariffs (subject to change): AC 22 socket 9.90 TL/kWh; DC socket 12.95 TL/kWh. The current list is on the Pricing page and in the app.
- A location-based idle fee of 3 TL/min may start 10 minutes after charging ends or is stopped. The Member is notified by SMS or the app and must free the socket.
- Payment is collected by methods Arcona accepts. Invoices are issued as required by law.
- Tariffs are set in line with Law No. 6446, the Charging Service Regulation and EMRA (EPDK) rules, and may be changed after prior notice.
5. Member obligations
- Use the unit, cable and site with care and report faults.
- Connect only a compatible connector and vehicle; do not endanger third parties.
- Follow parking and idle-fee rules and leave the bay when charging ends.
- Do not let others use the account commercially without Arcona’s written consent.
6. Arcona obligations
- Provide the charging service within its licence and the law.
- Process personal data under the Privacy Policy and the KVKK Privacy Notice.
- Provide reasonable 24/7 call and field support (+90 850 811 4020).
7. Limitation of liability
To the extent permitted by law, Arcona is not liable for delay, data loss or indirect damage caused by force majeure, grid outages, restrictions by a third-party site host, a fault in the vehicle’s battery or connector, or the Member’s misuse. In mandatory cases liability does not exceed the fee collected for the relevant session. Mandatory consumer rights under Law No. 6502 remain intact.
8. Intellectual property
The Arcona brand, logo, software, map interface and content belong to Arcona or its licensors. They may not be copied or used commercially without permission.
9. Term and termination
The Agreement is for an indefinite term. The Member may close the account; Arcona may terminate immediately for cause (payment default, misuse, breach of law). Termination does not cancel accrued debts or statutory retention duties.
10. Governing law and venue
The Agreement is governed by the laws of the Republic of Türkiye. Kayseri Courts and Enforcement Offices have jurisdiction. A consumer may also apply to the Consumer Arbitration Committee or Consumer Court at their place of residence under Law No. 6502. Ministry of Trade consumer line: 175.
11. Entry into force
Anyone who creates a membership or starts a charging session declares that they have read and accepted this Agreement. Arcona may update the text on the site; material changes are announced. Continued use is acceptance of the current text.
